A few years ago, I was suddenly in a situation I never imagined:
embroiled in a conflict with an insurer. At that time, I assumed
the claim process would go without problems, since from the beginning I
had completed the requirements, provided all documents, and kept up
with premiums on time. But things turned out differently.
The process became messy, my claim was postponed multiple times, and in the end, it was turned down without a clear explanation.
From that experience, I started to see that in the field of insurance, trusting goodwill is often not enough.
There are layers of legal complexity, ambiguous agreements, and regulations that are not
easily understood to the average person.
The question then arose: “In such cases,
do I really need a dedicated insurance attorney?”
What Are Policy Disagreements and Why Do They Happen Repeatedly?
When you look at it closely, insurance disputes are not uncommon. According to a survey by the University of Indonesia, Faculty of
Law (Santoso, 2021), more than a significant percentage of consumer complaints
in the financial services sector over the last five
years were related to insurance claims. That figure is
remarkably significant and shows that insurance issues are not just individual incidents,
but a widespread issue.
Some recurring patterns include:
– Claims being rejected for reasons that are unclear.
– Claim payments taking far longer than promised.
– Differences in application between the written policy and actual
practice.
– The insurer declared insolvent.
I recall vividly that the insurer at the time said my claim couldn’t
be processed because of an “exception in the policy.” Yet I
had read the policy many times, and in my view, that exception was completely
misplaced to my case.
What Does It Mean to Face an Insurance Company On Your Own?
Honestly, it felt like taking on a massive opponent. I, as an individual, had no strong legal access, while the company had lawyers on standby, rules, and time.
I tried to contact the Financial Services Authority (OJK) to
file a report, but the process was time-consuming. There were
mediations, clarification steps, and no guarantee it could all be resolved swiftly.
In that condition, I felt trapped. Until eventually, I started looking into the services of
an insurance lawyer.
Can a Lawyer Actually Make a Difference in Insurance Disputes?
The short answer is: absolutely—and they can be extremely helpful.
According to research from Airlangga University, Graduate Program
in Business Law (Rahman, 2020), consumers who were assisted by lawyers in insurance disputes had notably stronger chances of resolution compared to those who went through the process alone.
The reason is simple: lawyers understand legal loopholes, can decipher policies with a legal eye, and follow dispute
resolution procedures both inside and outside of court.
I once discussed this with a colleague who went through

According to a study by the Faculty of Law at Gadjah Mada University (Pradipta,
2019), more than 50% of insurance cases that reach court
can be secured for the insured if they are represented
by a dedicated attorney.
When Is the Optimal Time to Reach Out to an Insurance Lawyer?
From my experience, the sooner, the better. Don’t
postpone until the case gets worse and your position weakens.
Some signs you must consider assistance:
– Claim dismissed without proper reasoning.
– Claim payout dragging on.
– Indications that the company is not honest about the policy.
– The insurer is in distress.
At that point, an insurance lawyer is no longer a choice, but a essential support.
